Personally, I would have not said anything for fear of giving them free advertisement.
At any rate, I would think you need only to inform MSN of the violation and they will shut it down immediately. Major web portals do not want to be accused of supporting illegal activity regardless of whether anyone is prosecuted.
And the quicker you get the site shut down, the easier it will be to stop others. Afterall, who wants to waste their time - should I say "piss away" their time - setting up a site to have it shut down immediatly?
